    In the name of God Amen the three and twentieth day of February in the 14th year of the reign of our most gracious sovereign Lord Charles II by the grace of God king of England Scotland France and Ireland Defender of the Faith I Walter Burt of Cuckfield in the county of Sussex Tanner being sick and weak in body but of good and perfect mind and memory (praised be Almighty God for the same) do make and ordain this my last will and testament in manner and form following First I give and bequeath my soul into the hands of almighty God my merciful creator trusting by and through the only merits and mediation of Jesus Christ my only Saviour and Redeemer to receive pardon for all my sins and be made partaker of eternel bliss and happiness in his Kingdom of glory Also I give and bequeath unto the poor of the parish of Cuckfield aforesaid £4 of lawful English money to be paid and distributed amongst such poor of the said parish as the minister, churchwardens, and overseers of the poor within the same parish shall think fit within one month next after my decease Also I give and bequeath to the poor of the parish of Slaugham in the said county £3 of lawful money of England to be paid and distributed amongst such poor of the said parish of Slaugham as the minister churchwardens and overseers of the poor of the same parish shall think fit within one month next after my decease Also I give and bequeath unto my three grandchildren Susan Faulconer Sarah Faulconer and Mary Faulconer, daughters of Edward Faulconer and Sarah his wife, £20 apiece of lawful money of England to be paid them at their several and respective ages of one and 20 years or days of marriage which shall first happen And my will and mind is that the said Edward Faulconer shall in the meantime receive the interest of the said several legacies of £20, which in all amounts to three score pounds, for the better bringing up of my said three grandchildren and my will and mind is that if any of my said grandchildren Susan Sarah or Mary shall happen to die and depart this life before they shall attain their respective ages of one and 20 years or be married then the legacy and //
    legacies of £20 of her or them so dying before here in given and bequeathed shall be equally divided and remain to and amongst the survivor or survivors of them Also I give and bequeath to my nephew Walter Burt son of my brother Richard Burt £10 of lawful money of England to be paid to him within six months next after my decease Also I give and bequeath to my niece Timothy Burt daughter of my brother Thomas Burt £5 to be paid to her within six months next after my decease also I give and bequeath to my cousin John Garston of Bridge in Cuckfield £5 to be paid to him within six months next after my decease Also I give and bequeath to my nieces Anne Burt and Eleanor Burt daughters of my brother Henry Burt 40 shillings apiece to be paid to them within six months next after my decease Also I give and bequeath to all my godchildren except those who have legacies bequeathed to them in this my will 20 shillings apiece to be paid to them upon demand Also I give and bequeath to my nephew John Burt son of my brother Thomas Burt one annuity or yearly rent of £5 of lawful money of England, to be issuing and going out of all those my lands and tenements called Nashlands and Moorelands in Cuckfield aforesaid to have hold receive perceive and enjoy the same to the said John Burt my nephew and his assigns for and during the whole term and time of ten years next after my decease, and no longer, by half yearly payments to be paid by equal portions and for default of payment thereof that it shall and may be lawful to and for the said John Burt my nephew or his assigns to enter into and upon the said lands and tenements called Nashlands and Moorelands, any part there of and distrain, and the distress and distresses there found to take, lead, drive, carry away, impound, detain and keep until the said annuity of £5 and every part thereof and the arerages thereof be well and truly //

Also I give to my nephew Henry Burt son of my brother Henry Burt one other annuity or yearly rent of £5 of like money to be issuing and going out of the aforesaid lands and tenements called Nashlands and Moorelands to have hold receive perceive take and enjoy The same to the said Henry Burt my nephew and his assigns for and during the whole term and time of ten years next after my decease and no longer to be paid by half yearly payments by equal portions and for default of payment thereof that it shall and may be lawful to and for the said Henry Burt my nephew or his assigns to enter into and upon the said lands and tenements or any part thereof and distrain, and the distress and distressed there found to take, lead, drive, carry away, impound, detain and keep until the said annuity and every part there of, and all arrearages thereof be well and truly satisfied and paid Also I give and bequeath to my nephew Walter Burt son of my brother William Burt the aforesaid lands tenements hereditaments and premises with thappurtenances called Nashlands and Moorelands in Cuckfield aforesaid to have and to hold the same with appurtenances to the said Walter Burt my nephew and son of the said William and his heirs forever liable to and chargeable with the said annuities aforesaid in manner as is aforesaid Also I give and bequeath to the churchwardens and overseers of the poor of the parish of Cuckfield aforesaid and their successors the churchwardens and overseers of the poor of the said parish one annuity or yearly rent of 20 shillings of lawful money of England to be issuing and going out of all those lands and tenements with thappurtenances called Crosselands in Cuckfield aforesaid to hold receive perceive take and enjoy the same annuity of 20 shillings to the said churchwardens and overseas of the poor of the said parish and their successors forever to be paid to them in and upon the 20th day of December yearly forever and in default of payment thereof that it shall and may be //
    lawful to and for the said churchwardens and overseers of the poor and their successors to enter into and upon the said lands and premises with thappurtenances called Grasselands and distrain and the distress and distresses there found to take, lead, drive, carry away, impound, detain and keep until the said annuity of 20 shillings and every part thereof and all arrearages thereof be well and truly paid, upon this special trust and confidence that the said churchwardens and overseas of the poor and their successors, do yearly and every year, at the Feast of the Nativity of our Blessed Saviour, distribute the same 20 shillings to and amongst such poor of the north part of the said parish of Cuckfield, as they or the more part of them shall think fit, inhabiting within these bounds, and limits of the said parish, that is to say in any part of the said parish of Cuckfield lying on the east side of the lane leading from Handcrosse, to Holmsted Forge, and in any part of the said parish lying on the north side of the watercourse leading from Holmsted Forge to Pilstye Bridge Also I give and bequeath to my grandchild John Faulconer son of the said Edward Faulconer and Sarah his wife the aforesaid lands tenements hereditaments and premises with thappurtenances called Grasselands in Cuckfield aforesaid to have and to hold the same with thappurtenances to the said John Faulconer my grandson and his heirs forever, liable to and chargeable with the said annuity of 20 shillings forever in manner as is aforesaid Also I give and bequeath to my loving wife Elianor one hundred fourescore and five pounds of lawful money of England to be paid to her within three months next after my decease in full satisfaction payment and discharge of all bonds promises and agreements which I made upon my intermarriage with her, and so as she release the same, and all her thirds, and Dower, and right out of, and in all my copyhold and freehold lands. Also I give and bequeath to my said loving wife Eleanor one chamber in the house wherein //
    I now live and one bed, bedstedles, linen and all things convenient for her with free way and passage to and for the said Eleanor and her assigns to and from the said chamber so long as she shall remain a widow and no longer All the rest of my goods and chattels whatsoever not before herein given and bequeathed my debts being paid and my funeral expenses being discharged I give and bequeath to my four brothers Richard Burt Henry Burt Thomas Burt and William Burt to be equally divided amongst them within 12 months next after my decease by my executors hereafter named And I hereby make and constitute my brothers Henry Burt and William Burt executors of this my last will and testament and give two each of them £5 over and above all the reasonable charges and expenses in witness whereof I have to the last sheet of this my will set my hand and affixed my seal to the label at the upper end of this my will the day and year first above written

    Sharp’s and the Northover Finches Copice Botting’s feild and the tithes herein before devised and also by and with the residue and remainder of the lands called sextons and of the monies there of coming (if any be) raise and pay unto my said daughter Sarah the said sum of 100 pounds here in before to her given within six months next after my decease and also shall thereout and therewith raise and pay unto my son in law George Childrens the sum of 100 pounds for which I have given bond unto the said George and also the several legacies herein before given to the children of my said daughter Elizabeth Childrens and to the children of my said daughter Mary Attree and to the daughters of my son John Burt at such times as same are herein before respectively appointed to be paid and not otherwise and As for and concerning the legacies of 300 pounds apiece herein before given unto my three daughters Jane Rose and Charity my daughters by Anne my now wife Upon this trust and confidence that my said trustees shall by sale or mortgage of my said messuage and lands in West Grinsted called Pointers and of my lands in Cuckfield called Northlands or by sale or mortgage thereof or of any part thereof raise and pay unto my last named three daughters the several and respective sums of 300 pounds apiece at their several and respective ages of one and 20 years or days of marriage which shall first happen if they or any of them shall happen to attain the said age of 1 and 20 years or be married and not otherwise and in case any of my said three last named daughters shall happen to attain the age of 1 and 20 years or to be married in the lifetime of my said loving wife Anne their mother then my desire is that my said wife Anne shall relinquish all her right and interest in the said messuage and lands in West Grinsted and that//
    Then my said trustees shall sell the same and with the monies raised by such sale pay unto such daughter so attaining the age of 1 and 20 years or marrying in her mother's lifetime her said portion of 300 pounds and the over plus of the money raised on such sale shall deliver unto my son Richard Burt he the said Richard giving security to my said trustees to pay the interest of such over plus money unto my said wife until some other of my said three last named daughters shall attain the age of 1 and 20 years or be married and then to pay the said over plus money unto such other of my said last named three daughters towards the satisfaction of her portion of 300 pounds But if my said wife shall refuse to relinquish her right in the said messuage and lands in West Grinsted at the age of 1 and 20 years or marriage of the first of my said three last named daughters that shall attain to that age or be married then my will is that the said messuage and lands charged for the raising of their portions shall not be sold or mortgaged for raising the same until the death of my said wife it being my mind and will that my said trustees shall not sell or mortgage the reversion or remainder of the said lands or any of them but that what part soever is sold or mortgaged shall be sold or mortgaged in possession only for raising the said portions Also my will and mind is and I do hereby direct and appoint that my said trustees shall permit and suffer my said son Richard his heirs and assigns to receive the rents issues and profits of all and singular the premises respectively herein before devised in trust as aforesaid until such time as the same shall be respectively sold or mortgaged for the raising of portions or paying any debts as is before directed provided always nevertheless in case my wife Anne shall happen to die before the portions of my three daughters which I had by her or the portion of some or one of them shall become payable then//
    My will is that my trustees shall pay unto such daughter and daughters until her or their portions shall become payable the yearly sum or sums of 10 pounds apiece for her or their maintenance by equal quarterly payments out of the rents and profits of the said messuage & lands called Pointers and Northlands or any part of them or either of them And if it shall happen that any of my messuages lands tenements tithes or hereditaments or any part thereof shall be left after my debts and legacies herein before given shall be fully satisfied paid and discharged or if there shall be any over plus of monies left in my said trustees hands (their charges being first deducted) then and in such case I do hereby give and devise all and singular the said messages lands tenements tithes and hereditaments so left as aforesaid and the equity of redeeming the same (if mortgaged) unto my said son Richard Burt and his heirs forever And all such over plus of monies (if any be) I give unto my said son Richard Burt his executors and administrators and I give unto my son John Burt 5 shillings and I give unto my granddaughter Elizabeth Childrens my silver tankard marked with the letters E.B. and to each of my said trustees a pair of gloves of five shillings price and I do hereby make constitute and appoint my said son Richard Burt sole executor of this my last will and do direct and appoint that all my moneies goods chattels cattle and personal estate except my household stuff household goods and furniture and tankard herein before bequeathed shall be applied for the more speedy payment of my debts and legacies as the same shall first become payable And In Witness that this my last will and testament is contained in these six sheets of paper fastened together with a label I have thereunto set my seal and to every of the said sheets subscribed my name the day and year first above written

    A codicil to be annexed to the last will and testament of me Walter Burt of Cuckfield in the county of Sussex gent
    Whereas I the said Walter Burt do intend to surrender into the hands of the Lord of the Manor of Cuckfield Vicarage all that my copyhold messuage and all those lands tenements and hereditaments called Hardings holden of the said Manor to such uses as I by my last will and testament in writing shall herein limitt direct and appoint Now my will is and I do hereby give and devise all that my said messuage and all those my lands tenements hereditaments and premises called hardings to my loving wife Ann for and during her widowhood only and from and immediately after her death or marriage which shall first happen I give and devise the same to my son John Burt for and during the term of his natural life and from and after his decease to my grandson Walter Burt son of the said John Burt and to the heirs of the said Walter forever ^Also I give unto my son Richard Burt and his heirs all that Croft called Pellings Gardine adjoining to my lands called Northlands^ Also I give and bequeath all the wood faggots and hay now lying and being in and about my now dwelling house situate in Cuckfield aforesaid and also all those my four hogs five young shoots and four kine unto my said loving wife Anne. Also I give and bequeath unto Jane Burt my daughter which I had by my second wife Jane Holford one great wooden box now standing in the Garret of my said dwelling house and all the linen in the said box the same having been the linen of my second wife Jane before my intermarriage with her also I give unto my daughter Sarah the further sum of 50 pounds as an addition to her portion of 100 pounds to her before given the said 50 pounds to be raised and paid unto her in such manner as the 100 pounds before mentioned is appointed to be raised and paid and my will is that this codicil shall be and shall be adjudged and taken to be part of my last will and testament in witness whereof I have hereunto set my hand and seal the 5th day of September Anno Dm 1699

    A second codicil to be annexed to the last will and testament of me Walter Burt of Cuckfield in the county of Sussex gent
    Whereas I the said Walter Burt have by my last will and testament dated the first day of July Anno Dm 1699 given unto my daughter Jane which I had by my second wife Jane the sum of 200 pounds of lawful English money to be paid to her within six months next after my decease and have directed that the said monies shall be raised by Anthony Stapley and Richard Stapley and their heirs and assigns by sale or mortgage of the messuage farm and lands in Nuthurst called Sextens now my will is that my said daughter Jane which I had by my said second wife Jane shall forthwith after my decease by such conveyances and assurances in the Law as the said Anthony Stapley and Richard Stapley and their heirs any of them shall advise and require convey and assure unto them they said Anthony and Richard and their heirs subject to the trusts in my said will mentioned All the said premises called Sextens and all the right title and interest of in and to the same the said conveyances and assurances to be made at the charge of the said trustees and that they shall be reimbursed the same out of the monies raised by their sale or mortgage of the said premises and my will further is that in case my said daughter Jane shall refuse to make such conveyances and assurances as aforesaid that then the said sum of 200 pounds to her given by my said will shall cease and not be paid any thing in the said will to the contrary notwithstanding and I do hereby declare and my will is that this codicil shall be and shall be adjudged and taken to be part of my last will and testament. In witness whereof I have hereunto set my hand and seal this 20th day of September Anno Dm 1701.

    In the name of God Amen the 7 and 20th day of March in the second year of the reign of our sovereign Lord George by the grace of God of Great Britain France and Ireland King Defender of the Faith Anno Dm 1716 I Walter Burt of Cuckfield in the county of Sussex Yeoman being weak in body but of perfect mind and memory blessed be God for the same but calling to mind the uncertain estate of this life do hereby make this my last will and testament First I bequeath my soul to God who gave it hoping through the meritorious death of Jesus Christ to have full pardon for all my sins and my body I commit to the earth from whence it came to be decently buried at the discretion of my executor hereinafter named And as for what part of this world where with God has been pleased to bestow on me I give will and bequeath in manner and form following (that is to say) Item I will give and bequeath to William Burt my son all that my customary messuage lands and premises called Dekers with a new house lately built on part of the premises All which said messuages lands and premises are situate lying and being in Cuckfield in the said county to have and to hold to him and to his heirs forever Item I give will and bequeath to my son James Burt all that messuage or tenement and seven pieces or parcels of land called Heyholm containing ten acres more or less and also all these ten pieces or parcels of land being another part of a tenement called Heyholm containing by estimation eight and twenty acres more or less which said premises are all in the parish of Cuckfield in the said county to have and to hold to him and his heirs forever provided nevertheless and upon this condition that the said James Burt do within three months next after my decease pay to my executor the full sum of 30 and 5 pounds of lawful money of Great Britain to be distributed by them as is herein after directed Item I give will and bequeath to Alice Burt and Elizabeth Burt my daughters all that my customary messuage lands and premises in the parish of Slaugham called by the name of the Copyhold and Garstons Wood holden of the Manor of Magdalen College in Oxford to have and to hold to them and their heirs forever on this condition that they shall give sufficient discharges to my executors from any monies in my hands given to them by any person whatsoever (£50 given to Elizabeth Burt by her brother Thomas Burt deceased only excepted) Item I give will and bequeath to my granddaughter Mary Frances the sum of £10 to be paid to her within one year after my decease by my executor hereinafter named item I give will and bequeath to Anne my loving wife all the furniture of the hall chamber in my house wherein I now dwell and the sum of £10 in money the same to be at her own disposing the same sum to be paid to her within six months next after my decease Item all that my messuage at Mestam in the county of Surrey and all that my messuage at West Grinstead in the county of Sussex called Late Cottons being both freehold and also those two houses in Ardingly in the said county one of which lieth at Hapsted Green holden by lease and copy, the other at Ardingly Street both of the manor of Ditchling and also my cottage in Balcombe called Jolletts Cottage holden of the manor of Keymer and also all that cottage at West Street in Cuckfield aforesaid being freehold & all my goods and chattels I will give and bequeath to William Jupp of Cuckfield in the said county Yeoman with this confidence in him so reposed that he shall sell all the said cottages goods and chattels at the best prices that can be made of them and the money arising by such sale pay all my debts and legacies and do hereby give him full power and authority to do the same as well to all intents and purposes as I myself could do and after all my debts and legacies are paid the over plus if any be my mind and will is that the interest there of shall be paid to my loving wife during the term of her natural life and after her decease the said over plus to be divided in manner and form following (that is to say) Alice Burt to be made equal with Elizabeth that their portions may be equal and afterwards the remainder to be given between James Burt Alice Burt and Elizabeth Burt share and share alike my mind is that Elizabeth having £50 given her by her brother Thomas Burt so that her sister Alice shall have £50 before the devision of the over plus be made Item I give to the said William Jupp the sum of £1 over and above his necessary charges that he may be at in the discharge of the executorship//
    And I do hereby make my said loving cousin William Jupp whole and sole executor to this my last will and testament with the aforesaid trust in him so reposed and I do desire my loving cousin John Garston of Cuckfield gent to be overseer and to assist my said executor in the discharge of that trust put into his hands and I do give my said loving kinsman 20 shillings over and above his necessary charges that this is my last will and testament and no other in two sheets of paper In Witness whereof I have hereunto set my hand and seal the day and here first above written
